A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §61-10-33, relating
to making it a misdemeanor to make more than three calls to
911 for nonemergency health concerns.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §61-10-33, to read as
follows:
ARTICLE 10. CRIMES AGAINST PUBLIC POLICY.
§61-10-33. Calls to 911 for nonemergency health concerns.
(a) It is unlawful for any person to call 911 on more than
three separate occasions for nonemergency health issues, as
determined by the operator that takes the initial call. Any person
violating this section is guilty of a misdemeanor and, upon
conviction thereof, shall be fined $50.
(b) Upon the fourth call, emergency responders are still
required to respond to the call but are not required to transport
the person to the hospital.
NOTE: The purpose of this bill is to make it a misdemeanor to
make more than three separate calls to 911 for nonemergency health
concerns.
